Terms of Use

Vistavel is a service of Copdrive SAS, publisher of the vistavel.com website and of the Vistavel apps (legal notice in article 10) — contact@vistavel.com. These terms apply to the vistavel.com website and to the Vistavel apps for Android and iOS.

1. The service

Vistavel builds bike rides. You give a starting point, a distance, your type of bike and what you are looking for: viewpoints, water, heritage, nature, villages. Vistavel then offers several different routes. It shows the scenery in photos, flies over the route in 3D, gives the weather forecast, guides you by voice during the ride, exports the track as a GPX file, organises group rides and works offline. On the vistavel.com website, the basic service needs no account; the apps require signing in to a Vistavel account, which is free. Calculations run on our servers. When the server is busy, requests wait in a queue.

2. The account

You must be at least 18 years old to create an account. A new version of these terms must be accepted before you publish content again (section 4). An account needs an e-mail address and a password of at least 8 characters. You are responsible for this password. We do not keep it: we only store a salted hash (PBKDF2-SHA256). Creating an account means accepting these terms; the date and the version accepted are recorded. The same account works on the website and in the apps: your routes, your favourite places and your recorded rides are there.

You can delete your account at any time. How to do it, and what is erased, is described in the privacy policy.

3. Reserved features

Some features require a signed-in account; they are marked in the service.

4. Content published by users

Some features make what you create visible: a share link to a route or a ride, a catalogue proposal, a place correction or report, a challenge and your name on its ranking, an event, your first name, position and messages during a live ride, the content of groups and clubs, including the photo links and car sharing notices of an outing, the photos you send to the gallery of an outing or to a group album, or publish in the public gallery, your pseudonym, and the hazards you report on the “Reported hazards” map. You are responsible for it and you guarantee that you have the right to publish it.

Vistavel may add to the site's public catalogue an anonymous copy of the routes and rides you delete or hide, including those deleted or hidden before this version of the terms. Before it is added, the copy loses every link to your account and all personal data: your identifier, the name you gave it, its dates and times, its speeds, its passages through your private places, and 500 m at the start and at the end of the track, replaced for a loop by a computed section that avoids those surroundings. Its name and description are produced automatically from the places it passes through. You grant Vistavel, for these copies, a free, worldwide licence for the whole duration of the rights, to reproduce, adapt and publish them. As an added copy is no longer linked to your account, it can neither be returned to you nor withdrawn at your request.

Prohibited content: any illegal content; hateful or discriminatory speech and incitement to violence; harassment, threats and intimidation; sexual content; violent or shocking content; violations of other people's privacy, including publishing a third party's personal data (address, phone number, location) without their consent; spam, unsolicited advertising and misleading links; impersonating a person or an organisation.

Minors: zero tolerance. Any content that exploits or endangers minors, in particular sexually, is removed, the account concerned is deleted and the facts are reported to the competent authorities.

Outing photos: you only send photos that you took or that you have the right to share, and only if the recognisable people have agreed that they be shown to the participants of the outing; you declare it with every upload. Do not send the photo of a recognisable minor without the consent of their legal guardians. The photos are visible only to the participants of the outing and its organisers. You can delete yours at any time; an organiser of the outing can delete any photo of its gallery.

Public gallery: a photo published in the public gallery is visible to everyone, with your pseudonym. You only publish there photos that you took or that you have the right to share, and only if the recognisable people have agreed that they be shown to everyone; you declare it with every publication. Never the photo of a recognisable minor. Your pseudonym must not impersonate a person or an organisation. You can remove your photos at any time. A public photo may show where it was taken and the public catalogue route it was taken on. Likes must not be faked. Accepting a request makes the photo's route public, without its surroundings nor your private places, and proposes an anonymous copy of it to the catalogue.

Group albums: the photos of a group album are published content: the same rules and the same declarations as for outing photos apply to them.

Photos remain the property of their authors: you may not copy, save or reuse them without their consent (French Intellectual Property Code, art. L. 122-4).

Reporting: the “Report” button reports to the moderators a ride shared by a link, a route proposed for the catalogue, a challenge, a name on a challenge's ranking, a club, a sub-group, an organiser, an event, a photo of an outing's gallery, of a group album or of the public gallery, a pseudonym, a photo link or a car sharing notice of an outing, a participant in a live ride or one of their messages; a public photo and its pseudonym can also be reported without an account. If you appear without your consent in a photo sent to the gallery of an outing or to a group album, or published in the public gallery, choose the reason “I am in this photo without my consent”: the photo is hidden at once, until the moderators decide; this reason does not apply to a photo link. The “Block this person” button hides from each other what you and that person publish (outing photos and photo links, car sharing notices, group album and public gallery photos, a name on a challenge's ranking, challenges, sub-groups, first name, position and messages in a live ride), except in an outing that either of you organises; they are not told, and you can unblock them at any time from your account (“Blocked people”). A hazard on the “Reported hazards” map names no one: “Gone”, said on the spot by two accounts, removes it, and the moderators can hide or delete it. You can also write to contact@vistavel.com, and hide a participant on your device.

Moderation: routes proposed for the catalogue, challenges, and corrections and contributions to place sheets appear at once; the moderators check them afterwards and may remove them, in particular if they are inaccurate or misleading. Changes to a published club's profile, logo and location included, appear at once and commit its club leads; the moderators may withdraw a reported club. We also review reports. Depending on the seriousness and repetition of the facts, we may, without notice, remove content, including a photo, cut a share link, suspend or delete the account concerned. When the moderators remove content that is already public — a route proposed for the catalogue, a challenge, a correction or a contribution to a place sheet, a club — or suspend an account, the person concerned (for a contribution or a club, one of the club leads) receives the reasons by email, with how to contest the decision. We pass on to the authorities what the law requires of us.

Appeal: if you believe that content was removed or an account suspended wrongly, write to contact@vistavel.com: we review the decision and reply to you.

5. Your data

The data we process, who receives it, how long it is kept and your rights are described in the privacy policy. We sell no data.

6. Sources and ownership

The routes and places come from OpenStreetMap, queried through Overpass. The photos and the descriptions of places come from Wikidata and Wikimedia Commons; some street views come from Google Street View and Panoramax. The weather comes from MET Norway and the Deutscher Wetterdienst (through Bright Sky) and, when they do not respond, from backup services named under the forecast (National Weather Service, WeatherAPI.com, OpenWeather, Visual Crossing), on the site and in the Android and iOS apps alike; only older versions of the apps, until they are updated, still use Open-Meteo. Bike routing and elevation are computed with Valhalla and BRouter; the terrain of the 3D flyover comes from Mapzen's Terrarium tiles. The base maps come from MapTiler, OpenTopoMap and CyclOSM, among others. These sources keep their own licences and their own terms; their credits are shown on the map.

Vistavel includes Google Maps features and content (Street View images). Their use is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service (maps.google.com/help/terms_maps) and the Google Privacy Policy (policies.google.com/privacy).

Vistavel, its texts, its code and its layout remain our property. The tracks you export as GPX are yours: you may do what you want with them.

Vistavel is a registered trademark.

7. Liability

Routes are indicative. They may use roads open to traffic, or paths that are damaged, closed or impassable depending on the season. You remain responsible for obeying traffic law, for the condition of your bike and your equipment, and for judging the real conditions on site: traffic, surface, weather, the level of the riders. Turn back or change your path if conditions require it. We guarantee neither the accuracy of the map data, nor the availability of the service, nor a calculation time.

8. Changes

We may change these terms. The version in force is the one published on this page; its date is shown at the top. A new version is presented to you when you sign in: until you have accepted it, your account remains usable, but you cannot publish content (section 4).

9. Governing law

These terms are governed by French law. In case of disagreement, please write to us first at contact@vistavel.com; failing agreement, the French courts have jurisdiction.
